For what purposes and on what legal basis does Troy process personal data?
Troy processes your personal data for the purpose of your application for employment insofar as this data is needed to reach a decision on establishing an employment relationship with us. We process personal data about you insofar as this is necessary to defend against legal claims against Troy arising from the application process. Should an employment relationship between you and Troy be established, we can process personal data already received from you for the purposes of the employment relationship, should this be necessary to carry out or terminate the employment relationship or to exercise or fulfil the rights and obligations of the employee's representation of interest arising from a law, wage agreement, or a works or service agreement.

What categories of data recipients are there?
Troy may transfer your personal data to companies affiliated with us if this is permitted by law in your country. As Troy is an American company, data may be transferred to Troy and its affiliates in the USA. The data will be used solely for internal purposes and in strict compliance with data protection directives.

Personal data is also processed on Troys behalf based on contracts, in particular by hosting service providers or providers of applicant management systems.

For how long will your data be stored?
Troy will store your personal data for as long as it is needed to reach a decision on your application. Should an employment relationship between you and Troy not be established, then we may continue to store your data insofar as this is necessary to defend against possible legal claims. In this case, application documents will be deleted six months after notification has been given that your application has been rejected, unless these documents need to be stored for longer due to legal disputes.

What rights do you have?
As one of Troys applicants, you have - depending on the specific situation - the following data protection rights, which you can exercise by contacting Troy or Troys data protection officer at any time using the details provided:

  • Right to obtain information: You have the right to obtain information on your personal data that is being processed by Troy. This includes information on the purpose of usage, the category of data used, its recipients and those authorised to access it and, where possible, the envisaged period of data storage or, where this is not possible, the criteria for determining this period.

  • Rectification, erasure or restriction of processing: You have the right to obtain from Troy without undue delay the rectification of inaccurate personal data concerning you.

  • Right to object: Insofar as the processing of personal data, you have the right, based on reasons arising from your particular situation, to object to the processing of this data at any time. Troy will then no longer process this personal data unless there are compelling legitimate grounds for the processing that outweigh your interests, rights, and freedoms or the processing serves to establish, exercise, or defend legal claims. If the processing is based on your consent, then you can withdraw your consent at any time without affecting the legality of the processing carried out with your consent up to the point of withdrawal. To do so, you can contact Troy or Troys data protection officer at any time using the details provided above.

  • Right to demand: You have the right to demand that Troy erase personal data concerning you without undue delay, at which point Troy is obliged to erase personal data without undue delay where one of the following grounds applies:

    o

    The personal data is no longer necessary for the purposes for which it was collected or otherwise processed.

    o

    You object to the processing and there are no overriding legitimate reasons for the processing.

    o

    The personal data was processed unlawfully.

    o

    The personal data has to be erased to fulfil a legal obligation under the national law to which Troy is subject. This does not apply if the processing is necessary to fulfil a legal obligation that renders the processing necessary under the national law to which Troy is subject.

    o

    The personal data is necessary for you to establish, exercise, or defend legal claims.

  • Right to restriction of processing: You have the right to obtain from Troy the restriction of processing where one of the following applies:

    o

    You contest the accuracy of your personal data for a period enabling Troy to verify the accuracy of your personal data;

    o

    The processing is unlawful and you oppose the erasure of the personal data and request the restriction of use of the personal data instead;

    o

    Troy no longer needs the personal data for processing purposes, but you need it to establish, exercise, or defend your legal claims; or

    o

    You have objected to the processing, provided it has not yet been established whether Troys legitimate interests outweigh your own. Where the processing has been restricted in accordance with this subparagraph, this personal data may, with the exception of storage, only be processed with your consent or to establish, exercise, or defend legal claims, or to protect the rights of another natural or legal person or for reasons of important public interest of applicable country. If you have effected restriction of processing, Troy will inform you before the restriction is lifted.

  • Right to lodge a complaint: Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, your place of work, or the place of the alleged infringement, if you believe that the processing of the personal data concerning you infringes the laws of your country.

    Necessity to provide personal data:
    The provision of personal data is neither a legal nor contractual requirement, nor are you obliged to provide personal data. However, it is necessary to provide personal data in order to conclude an employment contract with Troy. This means that if you do not provide Troy with any personal data in your application, then Troy will not enter into an employment relationship with you.

    No automated decision-making:
    There is no individual automated decision-making, which means that the decision on your application is not solely based on automated processing.
